Terms of Service
Alpha policy · Version October 20, 2026
1. Who we are and your agreement
Kinden is a community communication service operated by Devon under the FennX name (“Kinden,” “we,” or “us”). Contact the operator at devon@fennx.org. These Terms govern the Kinden application, servers, direct messages, website, support, and related services. By explicitly accepting these Terms when registering, you agree to them and acknowledge our Privacy Notice. If you do not agree, do not create an account or use the service. This agreement does not waive rights that applicable law does not allow you to waive.
2. Eligibility and invitations
You must be at least 13 and meet any higher minimum age required in your country. If you are below the age of legal majority, your parent or legal guardian must agree to your use and these Terms. Kinden is not directed to children under 13. Do not register or provide personal information if you are under 13. Invitations are limited permissions to apply for an account; they are not transferable property and do not guarantee continuing access. Do not sell, publish, guess, or bypass invitation codes. We may expire or revoke unused invitations.
3. Your account
Provide an accurate email address, complete email verification, use a strong unique password, and keep your credentials private. You are responsible for activity you authorize through your account. Tell us promptly if you suspect compromise. Do not impersonate someone, misrepresent your authority, evade restrictions, sell accounts, or automate account creation. We may require additional verification or suspend access when reasonably necessary to protect an account or the service. Owner administration requires additional authentication.
4. Private communities and moderation access
Your servers and direct messages are private to their authorized members. They are not publicly searchable through Kinden. Human platform administrators may inspect private message content through the administration application only when that content is reported or flagged for suspected offensive content. Access is limited to evidence associated with that case and is recorded in the administration audit log. A report does not authorize unrestricted browsing of unrelated conversations.
Privacy is an access policy, not a promise of end-to-end encryption. This alpha stores messages and uploads on the Kinden infrastructure in a form the service can process. Automated systems may examine content to enforce rules or identify possible violations. The infrastructure operator has technical access to stored data; application restrictions cannot remove that capability. Exceptional disclosure or access required by applicable law, a valid legal demand, or an immediate threat to life may occur where legally permitted and necessary. We will record such access and limit its scope where practicable. Other members can copy, record, or share what you send; we cannot guarantee their conduct.
5. Community rules and offensive content
“Offensive content” means content or conduct prohibited below, including illegal, hateful, or discriminatory material. Context matters: good-faith reporting, education, news, and counterspeech are assessed in context, but do not permit exploitation or unlawful material.
- Do not post illegal material or use Kinden to facilitate crimes, fraud, trafficking, exploitation, or credible threats of violence.
- Sexual exploitation of minors, child sexual abuse material, grooming, and sexualized content involving minors are prohibited. Never upload such material to a support ticket as “evidence”; report its location instead.
- Do not promote hatred, dehumanization, violence, exclusion, or discrimination against people based on protected characteristics such as race, ethnicity, national origin, religion, caste, sex, sexual orientation, gender identity, disability, or serious medical condition.
- Do not harass, stalk, intimidate, repeatedly target someone after being asked to stop, encourage self-harm, or organize abuse.
- Do not share private personal information without authorization, threaten to expose it, or distribute nonconsensual intimate imagery. Respect consent and local recording laws in calls and screen sharing.
- Explicit sexual content and graphic violence are not permitted during this alpha. Do not exploit ambiguity in labels, images, usernames, cosmetics, links, or server descriptions.
- Do not distribute malware, phishing links, stolen credentials, or tools intended to compromise Kinden or other members. Report security vulnerabilities privately to the operator.
- Do not spam, scrape private content, evade rate limits, manipulate points, create bots without approval, or interfere with the service. Do not use alternate accounts to bypass a restriction.
- Only upload or share material you have the right to use. Respect copyright, trademarks, privacy, publicity, and other rights.
- Do not file knowingly false reports, retaliate against reporters, or obstruct a safety investigation.
6. Server owners, roles, and members
Server owners may create channels, categories, and roles and set additional community rules consistent with these Terms. They are responsible for the permissions they grant and for responding to problems in their communities. A server role does not grant platform administrator access. Invite only people you trust. Members should review channel permissions before sharing sensitive information. Removing a person’s membership prevents future access where supported but cannot retract content already downloaded or copied.
7. Your content and our limited license
You retain your rights in your messages, images, and other content. You grant Kinden a nonexclusive, worldwide, royalty-free license to store, transmit, display, format, and make technical copies of that content only as needed to operate the service, deliver it to authorized recipients, handle reports, protect the service, and comply with law. This license is not permission to sell your private conversations or use them to train general-purpose AI models. It ends when the content is deleted from our active systems, except for copies retained as described in the Privacy Notice and copies already received by others.
You are responsible for your content and for obtaining needed permissions. Kinden’s name, branding, application, and original assets remain the property of their respective owners. You receive a limited, revocable license to use the official app for personal communication in accordance with these Terms. Third-party components remain subject to their own licenses.
8. Reports, warnings, restrictions, and appeals
Use the message report control or in-app support to report suspected violations. Include enough context for review without repeating harmful material unnecessarily. Reports and automated flags create cases for review; a flag is an indication, not proof. Available actions include content removal, warnings, recorded violations, account flags, temporary suspension, permanent bans, and server closure. Severity, context, repeated behavior, evasion, and safety risks may affect the response. We may act immediately without an advance warning.
Kinden reserves the right to close, restrict, suspend, or terminate any account or server at any time, for any reason or no stated reason, to the extent permitted by applicable law. This discretion does not override nonwaivable legal obligations. We will provide notice or reasons when required by law and otherwise when practicable, unless doing so would create a safety risk, compromise an investigation, or be unlawful. Moderation actions and access to case evidence are logged.
You can request review through an in-app support ticket or email devon@fennx.org if you cannot log in. Identify your account and the decision; do not send passwords. Appeals are reviewed by the operator. An appeal does not automatically restore access, and we do not promise a particular outcome or response time. Kinden is not an emergency service.
9. Sparks and cosmetics
Sparks are free, nontransferable service points awarded under current activity rules and daily caps. They have no cash value, cannot be redeemed for money, and are not a bank balance, investment, or ownership interest. Award rates, caps, prices, and available cosmetics may change. We may reverse points obtained through bugs, automation, spam, or abuse. Cosmetics are limited licenses to display an appearance while available; they do not convey intellectual property rights. Alpha resets, moderation, or service closure may remove points or cosmetics. No real-money purchases are enabled in this version; any future paid offering will require its own disclosed terms.
10. Updates and alpha availability
The Windows app checks official release servers for updates in the background and may download an update automatically. It offers a restart control when an update is ready. Choosing it closes Kinden, installs the update silently, and reopens the app. Downloads use network bandwidth and storage. We may require security updates to continue connecting. The alpha may be incomplete, unavailable, interrupted, changed, or reset. Do not use it as your only copy of important material or as an emergency, medical, legal, or financial communication system. Screen-share quality depends on device capability, network conditions, and service limits; “up to 1440p at 30 fps” is a maximum target, not a guarantee.
11. Third-party services and links
Kinden uses Matrix/Synapse for messaging, Keycloak for identity, LiveKit for live media, OVHcloud for hosting, GitHub for application releases, and ChatGPT Sites for its download website. These providers and linked websites may have their own terms and privacy practices. Visiting an external link leaves Kinden’s control. We do not endorse user-posted links or guarantee third-party availability.
12. Ending your use and deleting data
You may stop using Kinden at any time and request account deletion through support or the contact address. We may need to verify control of the account. Deletion, safety evidence, operational records, backups, recipients’ copies, and lawful retention are handled as described in the Privacy Notice. Termination ends your permission to use the service but does not remove obligations or rights that by their nature survive, including content rights, dispute provisions, and outstanding legal duties.
13. Disclaimers and limits of liability
To the maximum extent permitted by applicable law, Kinden is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, or error-free security. We do not guarantee that every harmful item will be detected or removed. You remain responsible for decisions about whom to trust and what to share.
To the maximum extent permitted by law, Kinden and its operator are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or business opportunities arising from the service. Aggregate liability for claims relating to the service is limited to the greater of US $100 or the amount you paid Kinden in the preceding twelve months. These limitations do not exclude liability for fraud, willful misconduct, gross negligence where exclusion is prohibited, death or personal injury caused by negligence where applicable, or any liability or consumer remedy that cannot lawfully be limited.
14. New York law and disputes
New York law governs these Terms, except where mandatory law gives you protections that cannot be displaced by this choice. Please contact us first to try to resolve a dispute informally. Unless mandatory law requires another forum, disputes may be brought in a state or federal court of competent jurisdiction in New York, and both parties consent to that jurisdiction. These Terms do not impose arbitration, waive a right to a jury trial, prevent a claim in an eligible small-claims court, or restrict your right to contact regulators.
15. Changes and general provisions
We may update these Terms. We will identify the new version and provide notice of material changes in the app, website, or by email before they take effect when practicable and as required by law. Where consent is legally required, we will request it. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision is not a waiver. These Terms and incorporated notices form the agreement concerning Kinden; they do not create an employment, partnership, agency, or fiduciary relationship.
